The ICC is not democratically accountable to anyone

The International Criminal Court (ICC) is seeking arrest warrants for two Israeli leaders and three Hamas leaders on charges of war crimes, crimes against humanity and more. Among those who may be indicted is Israeli Prime Minister Benjamin Netanyahu, along with Israeli Defense Minister Yoav Gallant. The ICC leveled charges against Hamas for its Oct. 7, 2023 attack on Israel and against Israel over its collective siege, bombardment and invasion of the Gaza Strip.

The charges could further isolate both Israel and Hamas, whose leaders might soon join the ranks of other notorious leaders wanted by the court for similar crimes. The list includes Vladimir Putin of Russia.

Netanyahu has been a political leader. He’s had a long, distinguished career. He is combative. He’s controversial. But the people of Israel once again chose him to be prime minister. For some outside group to announce with no moral authority, with no possible structure of sovereign power, that they were going to issue a warrant for his arrest tells you how really out of control the world is. Are they going to arrest Putin? Are they going to arrest Kim Jong Un who runs one of the worst dictatorships in the world? That’s crazy.

And I think we have an obligation as Americans to stand up for the principle of sovereignty, the principle that our country is the base of legitimacy, that having a government which reports to the people, is elected by the people, and is accountable to the people, is the key to legitimacy, not some nameless bureaucracy.

I think it’s very important to recognize how dangerous these multinational institutions are becoming the notion that the International Criminal Court, which has no democratic representation, has no accountability to voters anywhere, is essentially just one more elite example of fancy people who work in bureaucracies, travel around the world, going to nice hotels, and have meetings with each other to tell each other how important they are. The fact that the International Criminal Court would say that it was considering arresting or putting out a warrant to arrest the legitimate Prime Minister of a country that is a democracy, where people actually do vote should have a pretty chilling effect on folks. There are a number of these institutions, the World Health Organization, the United Nations Relief organization that had at least 10% of its employees and Gaza, actively helping Hamas with terrorism. Again, and again, you look around you realize, we have seated a large part of trying to solve problems, to bureaucrats who are not elected, who are not accountable, who don’t report to elected officials of any kind, so that we, the voters, the people who are at the base of sovereignty, the people who, for example, in America, rebelled against the English king, and won our independence. We’re now inch by inch, watching our independence and independence of people everywhere, being taken over by these anonymous bureaucratic systems of power, made up largely of left wing people, intellectuals, who get together to reassure each other, how important they are, how morally superior they are, and how the rest of us should relax and let them run our lives. You know, Prime Minister Netanyahu, somebody I’ve known since the mid 1980s, is a remarkable person. He’s dedicated his whole life to serving his country. He served in the elite minutes of his military. His brother was the only Israeli killed in the rescue at Entebbe, when the Israelis had to go to Uganda to liberate an entire civilian airliner of people who had been kidnapped by terrorists. Netanyahu has been a political leader. He’s had a long, distinguished career. He is combative. He’s controversial. But the people of Israel once again, chose him to be Prime Minister, for some outside group to announce with no moral authority, with no possible structure of sovereign power, they were going to issue a warrant for his arrest tells you how really out of control the world is.

 

They’re going to arrest Putin, or they’re gonna rescue Kim Jong Un who runs one of the worst dictatorships in the world.

 

That’s crazy. And I think we have an obligation as Americans, to stand up for the principle of sovereignty, the principle that our country is the base of legitimacy, that having a government which reports to the people is elected by the people and is accountable to the people is the key to legitimacy, not some nameless bureaucracy.
