It protects not only individual speech but also the right of private organizations, including corporations, to express their values, make hiring and workplace culture decisions and engage in public advocacy. Yet. Now we have the Trump administration deploying federal power to undermine those rights. The FCC investigation into Comcast and NBC Universal’s diversity equity and inclusion efforts isn’t just a policy dispute. It’s an authoritarian attack on free speech itself. Make no mistake, this is not about enforcing civil rights laws, as FCC Chairman Brendan Carr falsely claims, it’s about punishing a private company for expressing values that the administration does not like. Comcast decision to champion dei is a form of corporate speech, and under the First Amendment, the government has no business coercing, punishing or chilling that speech. The Supreme Court has repeatedly affirmed that corporations have first amendment rights, whether they are funding political campaigns, a la Citizens United, or engaging in advocacy. If a company chooses to say that diversity makes it stronger, that is protected speech if it decides to invest in workplace policies that reflect that belief, that’s protected action. But now Trump’s FCC is sending a clear message, if a private company publicly affirms Dei, it will face regulatory retaliation. This is not just government overreach. It’s blatant violation of the First Amendment, and it follows a pattern that we have seen before. History shows us that when authoritarian movements take hold, one of the first tactics they employ is suppressing speech that they don’t like. Fascist regimes don’t just start with arrests and shuttering newspapers. It starts with states abusing their powers by punishing political opponents and chilling dissent. We’ve seen this playbook before. In the 1930s in Germany, businesses and cultural institutions were pressured to align with the ruling ideology or face consequences. In Russia today, companies and media organizations that don’t follow Putin’s line are harassed, find or shut down. This isn’t hyperbole, its textbook authoritarian maneuver, weaponizing government agencies to make an example out of corporations that refuse to fall in line. And let’s not forget, this investigation isn’t happening in isolation. PBS already shut down its dei offices under federal pressure. Major corporations like McDonald’s and meta have quietly scale back their dei initiatives, not because they don’t believe in them, but likely because they fear regulatory and legal threats. Trump’s executive order didn’t just ban dei in government. It instructed agencies to pressure the private sector to do the same. This is government coercion, plain and simple, and if they succeed in strong arming Comcast into submission, where does it stop? Will the FCC investigate news organizations for reporting on racial injustice? Will corporations be barred from running pro LGBTQ plus ad campaigns? Will tech companies face punishment for moderating disinformation on their platforms. This is the slippery slope of authoritarianism. Let’s be clear, you don’t have to support dei to be outraged by this. You just have to believe in the First Amendment, because today, it’s dei that’s under attack. Tomorrow, it could be corporate climate commitments. It could be newsrooms, independents. It could be our democracy the moment we allow the government to dictate what private entities can say and believe we have stepped into dangerous territory. This is not about diversity. It’s about democracy, and if we don’t fight back now, we may wake up one day in a country where free speech is a privilege, not a right.
FCC investigation into Comcast a blatant attack on free speech

The Federal Communications Commission’s (FCC) Enforcement Bureau launched an investigation into Comcast for allegedly “promoting invidious forms of DEI in a manner that does not comply with FCC regulations.” The FCC’s action follows President Donald Trump’s executive order ending diversity, equity and inclusion (DEI) programs across the federal government and directing U.S. agencies to “encourage the private sector to end illegal discrimination and preferences, including DEI.”
Comcast said it will cooperate with the FCC to address any questions. Three former FCC chairs have taken the rare step of publicly criticizing FCC Chairman Brendan Carr over these and other major concerns relating to press freedom, warning that his actions threaten free speech rights.
