Georgia’s top court reinstates 6-week abortion ban, considers state appeal

Georgia’s Supreme Court reinstated a 6-week abortion ban, prohibiting the procedure about six weeks into pregnancy, while it considers a state appeal. This means Georgia’s 6-week abortion ban will is back in place on Monday, Oct. 7, as the court reviews an appeal to a lower court’s decision that expanded access to abortion.

The ruling comes less than a week after a Fulton County judge overturned the 6-week ban, stating it violates the state’s constitution. The judge ruled that the state could only ban abortion after fetal viability.

The 6-week ban was signed into law by Gov. Brian Kemp, R-Ga., in 2019 but did not take effect until 2022, when the Supreme Court overturned Roe v. Wade, which had granted women a constitutional right to an abortion.

Now, abortion is regulated by each individual state.

Since the Supreme Court’s decision, about 20 states have implemented restrictions or near-total bans on abortion.

THIS MEANS GEORGIA’S 6-WEEK ABORTION BAN WILL BE BACK IN PLACE STARTING MONDAY – WHILE THE COURT CONSIDERS AN APPEAL TO A LOWER COURT’S DECISION – EXPANDING ACCESS TO ABORTION.

THIS RULING COMES LESS THAN A WEEK AFTER A FULTON COUNTY JUDGE OVERTURNED THE 6-WEEK BAN, STATING IT VIOLATES THE STATE’S CONSTITUTION.

THE JUDGE RULED – THE STATE COULD ONLY BAN ABORTION AFTER FETAL VIABILITY.

THE 6-WEEK BAN WAS SIGNED INTO LAW BY REPUBLICAN GOVERNOR BRIAN KEMP IN 2019 – BUT IT DIDN’T TAKE EFFECT UNTIL 2022 – WHEN THE SUPREME COURT OVERTURNED ROE V WADE – WHICH GRANTED WOMEN A CONSTITUTIONAL RIGHT TO AN ABORTION.

NOW, ABORTION IS UP TO EACH INDIVIDUAL STATE.

SINCE SCOTUS OVERTURNED ROE, ABOUT 20 STATES HAVE IMPLEMENTED RESTRICTIONS OR NEAR TOTAL BANS ON ABORTION.
