DOJ to pause Trump investigation as court appoints special master

A special master will be involved in the Justice Department’s investigation into former President Donald Trump’s possession of classified materials. The impartial third party is set to review the documents seized from Mar-a-Lago last month. A judge made the decision to grant Trump’s request for a special master on Monday.

The DOJ was also ordered to pause its own review of materials until the outside expert joins its investigation. The special master will have rights not only to see documents taken but to put aside unrelated items seized potentially protected under attorney-client privilege or executive privilege. In last week’s hearing, the DOJ asked the judge to deny the special master request. They said it would only prolong the investigation as it is put on pause.

Both sides will now submit a list of legal experts qualified to potentially be named special master to the court by Friday. FBI agents in August seized roughly 11,000 documents and 1,800 other items from Mar-a-Lago as part of a criminal investigation into the retention of national defense information there, as well as into efforts to obstruct the probe. About 100 of the documents contained classification markings.
